Terms and conditions

World Photography Tours makes every effort to provide a photography tour that is not only great fun but a great learning experience for all involved.  It’s Francis’s genuine desire that by the end of the tour you will not only have great memories and an amazing collection of photographs but also photographic techniques you can use for the rest of your life.


INTERPRETATION

Where we use the words "World Photography Tours", "us", "we" and/ or "our", we are referring to Francis Keating trading as World Photography Tours /Brisbane Photography Courses .These Booking Terms and Conditions apply to all bookings whether made in our office, online, through our website or by any other means of electronic communication. Where we use the words "customer", "you" and/ or "your", we are referring to you as the travel customer.


BOOKING TOURS

In order for you to come on a tour arranged by World Photography Tours, you must make a booking. This is done by paying a deposit of 25% of the total advertised price or 100% of the total advertised price. It is your responsibility to ensure that the booking dates and the tour are suitable for your requirements and capacity (including your physical and medical state and any disability from which you may suffer), in every respect.

Provided that there is space available on the tour booked and that World Photography Tours is satisfied that there is no good reason to refuse the booking, World Photography Tours will confirm the booking in writing or email. Paying 25% deposit of the total advertised price only confirms your booking. You must then pay the balance of the advertised tour price no later than 60 days prior of tour departure. Only by paying 100% of the total advertised price will the booking be complete and your place guaranteed for the tour.

If, for whatever reason, a booking is not confirmed, World Photography Tours will make a full refund of the booking payment made by you, except where you cancel the confirmed booking, other than in accordance with our cancellation policy the balance of any booking payment held by World Photography Tours/Brisbane Photography Courses will be refunded.

As soon as possible, booking confirmation will be sent to you normally within 7 days of making payment for the tour, by World Photography Tours/Brisbane Photography Courses. Prices are quoted in Australian dollars. Tour prices are per person, and are correct at time of publication and can be subject to change at the discretion of World Photography Tours.

FOOD & DRINK

Breakfast will be at the hotel or packed .Lunches will be informal, either packed or taken in one of the many shops or small restaurants that sell delicious local delights. This will allow maximum flexibility. Dinners will be at the hotel , cafeteria style or sit down restaurants with possible occasional picnic style dinners. Your guide will give you ideas where to eat if you prefer to dine on your own. A 600ml Bottle of water is provided daily .The purchase of alcohol is at your own expense. We assume no liability for any dietary requirements you have.

ACCOMMODATION

World Photography Tours includes high quality accommodation on all tours and in every city where possible. Sometimes due to the remote locations of the places we visit we may not be able to find the usual high standard of accommodation. Accommodations are based on double occupancy (two people sharing a room) requests for single occupancy are assigned on a first-come, first-served basis and are subject to a supplemental fee of $570.

CHANGES IN SERVICES

World Photography Courses reserves the right to cancel or make changes in the published itinerary whenever, in its judgment, conditions warrant, without consulting the participants. Participants have no right to any refund or other considerations in the event of these itinerary changes.

World Photography Tours is not responsible for any other travel arrangement and their associated costs due to our cancellations or amendments. Where amendments beyond our control require us to add or amend a service/s resulting in an increased operating cost, a surcharge may be payable by you for the additional or amended service/s.

If the group falls below the minimum requirement of 8 paying participants to 6-7, the photography tour is subject to cancellation or a small group supplemental fee of $500.


CANCELLATION

World Photography Tours may cancel a tour at any time prior to commencement due to any unforeseen circumstances or acts of God that are not in our control and restricts us to operate the planned itinerary. If the minimum numbers of participants to run the tour is not reached (8) or otherwise and in the unlikely event that we do not run a tour and if a client has paid an advance or full payment, the amount so paid will be refunded back to the client. This refund will be the limit of World Photography Tours liability. World Photography Tours is not responsible for any issues, damages or expenses which may arise as a result of the cancellation.

Due to the extensive organization involved with running a tour, a strict cancellation fee will be applicable to compensate for costs and lost revenue. Once a booking is made the following cancellation fees will apply:

CANCELLATION AND REFUND POLICY

In order to book a place on World Photography Tours you need to pay the fee in full at the time of booking or at the very least a retainer fee of 25%. The retainer will secure your place on tour and is non refundable should you choose to cancel for any reason

The remaining balance of the cost of the tour is due no later than 60days prior to the commencement of the tour.

MORE THAN 60 DAYS BEFORE DEPARTURE:

If for any reason you need to cancel your place on the tour you may do so prior to 2 calendar months before the Photography tour date, a $500 cancellation fee from the remaining amount must be paid ( or will be held) as well as the 25% non-refundable retainer. All money paid aside from these will be refunded.

LESS THAN 60 DAYS BEFORE DEPARTURE:

Should you cancel during the last 2 months leading up to the Photography Tour any money paid will not under any circumstance be refunded. At this point it is highly unlikely World Photography Tours will be able to refill the vacant place or downsize accommodation and rearrange plans.

If you need to cancel in the final 2 months leading up to the tour you may offer the place to a family member or friend as long as this person agrees to all the terms and conditions. World Photography Tours is not responsible for any third party arrangements. You can book another tour at a later date of equal or higher value to the original tour booked . Any cost differences must also be paid, this includes cancellation fees from the original tour.

No cash refunds will be given and no refund of any fees will be made for withdrawal after the tour begins.

YOUR OBLIGATIONS

You must ensure that any medical or other attendance that you require is provided by you.

You agree you may be photographed or videoed in the course of the tour for the purpose of World Photography Tours future publicity and that any written comments you make about the Course may be published by World Photography Tours.

Copyright in all photographs, video, and related materials ("Photo Tour Materials") created by the participant shall belong to the participant upon creation. The participant grants to World Photography Tours, its owners, agents and subsidiaries, and the Photo Tour Operators, Francis Keating a non-exclusive, worldwide, irrevocable license to use any Photo Tour Materials provided to World Photography Tours Operators in any media for the following limited purposes: editorial use, promotion of this editorial use, promotion of Photo Tours / Workshops, or promotion of Photo Tours /Workshops.

You agree to abide by any reasonable directions (especially any given on account of health and safety), given by World Photography Tours representatives in the running of a photography tour.

You agree to conduct yourself in a manner that is respectful of the group and other participants and, in particular that you will do nothing which might endanger the health and safety of any person involved in the tour or which might result in personal injury to any person or loss of or damage to property belonging to World Photography Tours its representatives or other clients. . Any use of illegal drugs or substances, committing or participating in any criminal or illegal activity & violence of any sort will not be tolerated and will result in the participant's immediate removal from the Photo Tour / Workshop, without refund and at the participant's expense. Photo Tour leaders are authorized, and hereby reserve the right, to remove or exclude participants from the Photo Tour / Workshop, or any portion thereof, for actions they deem as inappropriate or disruptive to the group or Photo Tour.

You agree to inform us of any special requests at the time of booking. We will advise the relevant suppliers of such requests but cannot guarantee that they will be met. Furthermore, World Photography Tours has no liability to you if such requirements are not met.

You agree to, World Photography Tours to act for you, according to their best judgment in any emergency requiring medical attention.

LIABITY OF TOUR COMPANY

By choosing to participate in a World Photography Tours Tour, you are accepting certain risks. Your application shall serve as a release of our liability and a complete assumption of all risks by you and your heirs, administrator, executor, successors, and assign for all family members. By accepting our terms of service with the signature of this waiver, you fully acknowledge that you are aware that travel, wherever it may be, and by whatever means, involves some inherent risk of injury, illness, death, loss, or damage to personal property, which may be caused by acts of nature, negligence or actions of others.

In consideration of, and as part of the payment for your participation in a photography tour or any program that World Photography Tours, or their assigns, may be conducting, you are voluntarily releasing World Photography Tours, their employees, assigns, independent contractors, or anyone involved thereof, from any damages, liabilities, costs, damage to or loss of equipment of other valuables, injuries whether mental or physical, known or unknown, and by participation you agree to assume all risks yourself, whether known or unknown. You acknowledge that your choice to travel to areas that may be remote, foreign, mountainous, wilderness, wild rivers, remote deserts, and rugged coastal areas all of which may not be maintained to the standards to which you are accustomed, may therefore involve certain additional risks, dangers, and inconveniences including, but not limited to, terrorism, forces of nature (force majeure), wild animals, hotel accommodations, airplane, vehicles, trains, boats, roads, walkways, trails, and other means of conveyance or other unknown risks. You acknowledge that medical services and facilities may not be readily available during all or part of the trip, including medical care, presence of physicians, and medication. We assume no liability for medical care. We assume no liability for dietary requirements you have.

Where World Photography Tours uses services from other third party suppliers that include, but are not limited to, transportation, accommodations, meals, and excursions using local guides, we will not be responsible for the willful or negligent acts and/or omissions of such suppliers, their employees, agents, servants, or representatives, including, without limitation, their failure or inadequate delivery of services. All travel and arrangements are subject to the terms and conditions specified by the suppliers, air carriers and/or applicable governing laws. World Photography Tours and the suppliers providing transportation or any service can accept no responsibility for losses or additional expenses due to but not limited to delay, inconvenience, changes to or cancellation of itinerary, sickness, weather, strike, war, quarantine, terrorism, defects in vehicles, breakdown in equipment, animals including transportation by animals, hiking, and any act, omission, negligence or other causes beyond their control. All such losses or expenses will be borne by the passenger, as photo tour rates provide for arrangements only for the time stated. World Photography Tours is not responsible for expenses incurred by trip members in preparing for the trip (i.e.: air tickets, visa/passport fees, equipment, medical expenses, individual transfers, etc.).

World Photography Tours shall have no liability to you for any loss, damage, costs or expenses or other claims for compensation arising from any instructions supplied by you which are incomplete, incorrect, illegible, out of sequence or in the wrong order or form, or arising from your late arrival, non-arrival or any other fault of yours or a third party.

Children under 18 years of age must be accompanied by a parent, guardian or a responsible adult. World Photography Tours is not responsible for any act or omission of yours which results in death, personal injury or loss of, or damage to property of any other client. At all times, World Photography Tours reserves the right to not accept children on Courses due to safety concerns.

You also acknowledge that you understand that travel with a group invariably involves compromise in order to accommodate the diverse desires, travel goals, personalities, and physical abilities of group members. You also agree that while itineraries are carefully planned, they are not a guaranteed schedule of activities, events, or participation, but only an intended guideline subject to available conditions on location. Group participants must allow for flexibility and changes deemed necessary by the program leader or professional guides, according to situations that may arise beyond our control, including but not limited to geographic, climatic, physical, or governmental restrictions that will cause further changes in timing, locations, and activities. In acknowledging this, you further agree that there will be no discounts or refunds for activities curtailed or otherwise affected by such circumstances.

You have assumed the responsibility to select an activity appropriate to your physical abilities and interests. You are personally responsible for being in sufficiently good health to undertake the activity. By submitting this signed application and by your deposit, you accept our terms of service, and you certify that you do not knowingly have any physical or other considerations of disability that would create a risk for you or other participants. We reserve the right to request a doctor's statement of good health.

You will be responsible for studying all pre-trip information; for bringing all equipment, personal items, and appropriate clothing; for conforming to standards of dress and hygiene; and for acting in a manner considerate of fellow participants, locations and environments, models, and locations. We reserve the right to cancel any activity and to accept or reject any person as a member of any activity at any time before or during the tour for which you are applying. The program, workshop, expedition, excursion, or trip leader's judgment shall provide the ultimate determination of an individual's ability to participate in, or continue to participate in, any activity or program. In acknowledging this, you further agree that there will be no discounts, refunds, or cost reimbursements resulting from activities curtailed or otherwise affected by such circumstances.

You acknowledge that travel to foreign countries entails unanticipated risks which could result in physical or emotional injury, paralysis, death, or damage to yourself, to property, or to third parties. You understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include, among other things: the hazards of walking on uneven terrain (cobblestones) and slips and falls, street mugging's, hijacking, your own physical condition.

You expressly agree and promise to accept and assume all of the risk existing in this activity. Your participation in this activity is purely voluntary, and you elect to participate in spite of the risks.

You hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless World Photography Tours from any and all claims, demands, or causes of actions, which are in any way connected with your participation in this activity, including any such claims which allege negligent acts or omissions of World Photography Tours.

TRAVEL ADVICE & INSURANCE

World Photography Tours strongly recommend that you contact the Australian Department of Foreign Affairs or visit their website at smartraveller.gov.au. This website contains valuable information and advice including safety alert levels relating to your travel destinations. It also allows you to register your travel plans with that department so that you can be contacted if an emergency arises

Insurance for medical emergency, including repatriation in any such event, is not included in the cost of the Tour. World Photography Tours are not medical practitioners and cannot provide advice as medical practitioners.

World Photography Tours must be informed of any health issues which may affect the Course, e.g. asthma, diabetes, heart condition etc.

It is a condition of booking that all participants be covered by comprehensive travel insurance and do not travel against medical advice. You should organize travel insurance immediately you book so as to be covered in case of the ill health of yourself, a close relative or your travelling companion and the possibility of damage to your photographic equipment and other personal valuables.

Loss or damage to your personal equipment is not covered by World Photography Tours insurance.

FORCE MAJEURE

FORCE MAJEURE – unforeseeable circumstances that prevent someone from fulfilling a contract.

Neither party shall be liable for any breach of its obligations resulting from causes beyond its reasonable control including fire, natural disaster, war, military hostilities or terrorism and strikes of employees. It does not include merely inclement weather conditions.

Each of the parties agrees to give notice immediately to the other upon becoming aware of an event of force majeure such notice to contain details of the circumstances giving rise to it.

Neither party shall have any liability to the other in respect of the termination of this agreement as a result of force majeure, except in relation to liabilities accrued before the occurrence of the force majeure.

SUCCESSORS TO THE AGREEMENT

World Photography Tours is entitled to assign the benefit of this agreement.

The benefit and obligations of this agreement shall be binding on any successor in title.

SEVERABILITY AND WAIVER

If any of these terms is at any time held by any jurisdiction to be void, invalid or unenforceable, then it shall be treated as changed or reduced, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from being void and it shall be binding in that changed or reduced form. Subject to that, each provision shall be interpreted as independent and severable from each other paragraph and therefore separately enforceable.

No delay by World Photography Tours in exercising any right, power or provision hereunder shall operate as a waiver of the exercise of any right at a future time.

ENTIRE UNDERSTANDING

This agreement contains the entire agreement between the parties and supersedes all previous agreements and understandings between the parties. Each party acknowledges that, in entering into this agreement, he does not rely on any representation, warranty or other term not forming part of this agreement, including by reference.

DISPUTE RESOLUTION

In the event of any controversy, claim or dispute arising out of or relating to this Agreement or the performance hereunder, the parties undertake to attempt to settle the dispute by engaging in good faith with the other in a process of mediation before commencing arbitration or litigation.

Subject to the above paragraph, if any difference shall arise between any of the parties touching the meaning of this Agreement or the rights and liabilities of the parties, the same shall be referred to arbitration by a single arbitrator to be appointed, on the application of either side.

PRIVACY

World Photography Tours will not share your contact information with any third party organisation, however by agreeing to these terms you allow Incredible Photos Tours to send you email reminders about your upcoming bookings and information on future tours and courses.
